EXPERTISE

Erin’s practice encompasses both Indigenous law and corporate commercial litigation. She assists Indigenous Nations and Organizations with navigating internal and external dispute resolution, including those involving the assertion of Indigenous laws; the assertion of Aboriginal rights and title; the intersection of Indigenous law and Canadian common law; the use of reserve lands, traditional territory, and natural resources by the nation, its members, and/or third parties; membership; governance; and commercial arrangements with third parties.

Notably, Erin assisted in three judicial reviews to the Federal Court of Appeal of the Trans Mountain Expansion Project by Stó:lō Nation communities. She also co-represented the Nuu-chah-nulth Tribal Council before the BC Court of Appeal as an intervenor in a landmark commercial fishing rights case and a Charter challenge regarding Indigenous cultural representations in public schools, and co-represented various First Nations in the Canada Energy Regulator reconsideration hearing for the Trans Mountain Expansion Project.

Erin was a member of the legal team representing the plaintiff class members in class action proceedings commenced in the Federal Court against the Federal government for the discriminatory treatment of First Nations youth, which resulted in the largest class action settlement in Canadian history.

Erin’s corporate commercial practice includes assisting clients with a range of business disputes, including those involving allegations of conspiracy, shareholder oppression, breach of fiduciary duty, breach of contract, professional negligence, and defamation. She helps clients obtain and challenge pre-judgment orders, including pre-judgment garnishment and security for costs.
